Richard K. Muser functions as Partner with Clifton Budd & DeMaria, LLP, where he concentrates his practice in the area of employment and employee benefits law litigation. Mr. Muser has represented a number of employers in challenging withdrawal liability assessments under the Multiemployer Pension Plan Amendments Act. He has also represented employers in State and Federal courts in defense of a wide range of employment-related claims including wrongful discharge, employee discrimination and litigation in connection with the enforcement of restrictive covenants.

Furthermore, a substantial portion of Mr. Muser’s practice deals with litigation under ERISA, representing employers and employee-sponsored pension plans in litigation regarding plan changes or benefit denials. For example, he successfully defended a company’s removal of a union-appointed trustee from its pension plan in federal court in Galusha, et al. v. Strachon, et al. Mr. Muser is also actively involved in conducting seminars on a wide variety of labor relations and employment topics. The programs involve instruction on issues such as grievance handling, contract administration, employee discrimination, compliance with ERISA’s reporting and disclosure obligations and sexual harassment in the workplace.

Mr. Muser received his Juris Doctor from Washington & Lee University School of Law where he graduated magna cum laude and was elected to the Order of the Coif and was a recipient of the American Jurisprudence Award for Labor Law, Creditor’s Rights and Security Interests. He also earned a Bachelor of Arts degree from St. Lawrence University.

Mr. Muser was admitted to the Bar in New York and New Jersey, the United States Supreme Court, the United States Court of Appeals in the Second, Third and Fourth Circuits, and Federal District Courts of New Jersey and Southern, Eastern and Northern New York. He currently is a member of the New York Bar Association and the Labor and Employment Law Section of the American Bar Association.
